General terms and conditions of business

1. Contractual relationship
The Purchaser recognises the following terms and conditions of Ballenberg Open-Air Museum (hereinafter referred to as FLM) as the basis for the purchase of the items published. Contractual relationships arising from the sale exist exclusively between the Purchaser and FLM. By purchasing an item, the Purchaser concludes a valid contract with FLM for the products/services purchased.



2. Payment
Payment is only possible with a credit card or on account. Postcard, Visa and Mastercard are accepted when paying by credit card.

 


3. Delivery
The precise delivery times can be seen in the relevant item description. In general letters have a delivery period of two working days. The delivery period for products which are sent as a parcel can take up to seven working days. The risk lies with the Purchaser for any delays and the loss of the products in transit. Any liability is rejected. Tickets and vouchers can be sent by post or easily printed at home.

Please note that there may be two deliveries to simplify the processes. The invoice will only be sent to you once.

Please note that it is not possible to send items abroad. Parcels and letters can only be sent within Switzerland. If we receive an order for delivery abroad, the order will be cancelled.

 

4. Validity of the tickets
The tickets entitle visitors tostay on the premises of the FLM during the opening hours from 10 am until 5 pm. The tickets for the FLM are valid for the current season. Tickets cannot be reimbursed for cash in the FLM. If there is a credit balance in favour of the holder, no change will be given. Items which are not paid for will not be accepted for payment. Staff of the FLM are authorised to ask visitors for their entry tickets and to check the latter. The appropriate identity cards are to be presented without prompting for reduced price tickets. Only those tickets are valid, which were purchased via official sales channels. Tickets for one entry bear a counterfeit-proof barcode and give entitlement to one direct entry. They do not have to be exchanged at the ticket office but can be scanned directly at the turnstile.



5. Validity of vouchers
The vouchers berechtigen die Besucher zum Aufenthalt im Gelände des FLM während der Öffnungszeiten von 10.00 Uhr bis 17.00 Uhr. The FLM vouchers are valid for three years as of the date of issue. After this period has expired, the value of the vouchers will continue to be accepted by the FLM. If the offer price is more expensive, the holder of the voucher must pay the difference to the current price. Vouchers cannot be reimbursed as cash in the FLM.  If there is a credit balance in favour of the holder, no change will be given. Items which are not paid for will not be accepted for payment. Only those vouchers are valid, which were purchased via official sales channels. Vouchers from FLM and its partner companies must be presented and exchanged in physical form at the West or East entrances. Vouchers for one entry bear a counterfeit-proof barcode and give entitlement to direct entry. They do not have to be exchanged at the ticket office but can be scanned directly at the turnstile.



6. Returns and exchanges
Purchases made in the FLM’s online shop are binding. They can neither be reversed, amended nor reimbursed after the purchase. If the products in the online shop have been paid at shop.ballenberg.ch, they cannot be cancelled or exchanged.



7. Misuse
Every voucher as well as every ticket can be redeemed only once. Copying, amending or counterfeiting tickets/vouchers is forbidden. It is the responsibility of the Purchaser to ensure that no additional tickets/vouchers with the same barcode are printed, copied and put into circulation. Misuse will be prosecuted and reported. When the voucher is redeemed, the code will be checked in the system for its validity and payment status.


8. Conduct and safety
Museum visitors are obliged to comply with all the safety regulations and code of conduct of the FLM and also follow instructions from staff. The FLM is not liable for accidents, which are caused by failure to observe the safety regulations and code of conduct. Children must be accompanied and supervised by an adult. Dogs must be led on a short lead.



9. Weather conditions
The FLM recommends bringing warm, rain-proof clothing suitable for the weather conditions. The weather is no reason to return vouchers and entrance charges. In the event of a violent thunderstorm, the Museum may be closed at short notice. Reimbursement of the entry charge is not guaranteed.



10. Place of jurisdiction
The contractual relationship is subject to Swiss law. Visitors to the Museum recognise Brienz as the exclusive place of jurisdiction for any disputes in connection with a visit to the Museum.
